Section 35700 of the California Health and Safety Code provides that the practice of discrimination because of race, color, religion, sex, marital status, national origin or ancestry in housing accommodations is against public policy.

Under Section 125.6 of the California Business and Professions Code, California real estate licensees are subject to disciplinary action by the Real Estate Commissioner if they make any discrimination, distinction or restriction in negotiating a sale or lease of real property because of the race, color, sex, religion, ancestry or national origin of the prospective buyer. If any prospective buyer or lessee believes that a licensee is guilty of such conduct, he or she should contact the Department of Real Estate.

SPECIAL NOTES

1. THE UNIFORM BUILDING CODE, CHAPTER 70, PROVIDES FOR LOCAL BUILDING OFFICIALS TO EXERCISE PREVENTATIVE MEASURES DURING GRADING TO ELIMINATE OR MINIMIZE DAMAGE FROM GEOLOGIC HAZARDS SUCH AS LANDSLIDES, FAULT MOVEMENTS, EARTHQUAKE SHAKING, RAPID EROSION OR SUBSIDENCE. THIS SUBDIVISION IS LOCATED IN AN AREA WHERE SOME OF THESE HAZARDS MAY EXIST. SOME CALIFORNIA COUNTIES AND CITIES HAVE ADOPTED ORDINANCES THAT MAY OR MAY NOT BE AS EFFECTIVE IN THE CONTROL OF GRADING AND SITE PREPARATION.

PURCHASERS MAY DISCUSS WITH THE DEVELOPER, THE DEVELOPER’S ENGINEER, THE ENGINEERING GEOLOGIST, AND THE LOCAL BUILDING OFFICIALS TO DETERMINE IF THE ABOVE-MENTIONED HAZARDS HAVE BEEN CONSIDERED AND IF THERE HAS BEEN ADEQUATE COMPLIANCE WITH CHAPTER 70 OR AN EQUIVALENT OR MORE STRINGENT GRADING ORDINANCE DURING THE CONSTRUCTION OF THIS SUBDIVISION.

3. THIS PROJECT IS OFFERED ONLY ON A LIMITED SEASONAL AND RECREATIONAL BASIS FOR THE PERIOD FROM MAY 1 TO OCTOBER 31.

4. YOUR ATTENTION IS ESPECIALLY DIRECTED TO THOSE SECTIONS HEADED “ELECTRICITY” AND “TELEPHONE”.

LOCATION AND SIZE: This subdivision contains 44 parcels on approximately 1,630 acres in Tehama County at Red Bank and Balis-Bell Roads approximately 16 miles from Red Bluff.

TITLE: Title is vested in Edwin E. Day, Trustee, under trust agreement dated April 30, 1971.

A Land Conservation Agreement pursuant to the Williamson Act with the County of Tehama, except Parcel Map Nos. 386 and APN’s 21-210-16 through 19.

EASEMENTS: Easements for utilities and other purposes are shown on the title report and survey map recorded in the Office of the Tehama County Recorder, Book R of Maps, page 87.

MINERAL RIGHTS: You will not own 45% of the mineral, oil and gas rights under your land. These have been reserved as follows:

        In a deed from E. E. Day to Call Realty Company, Inc., recorded in Book 554, Page 354, which provides as follows: “except that grantor shall have no right to enter upon any portion of such property without the prior written consent of grantee or grantee’s successors in interest.”

RESTRICTIONS: This subdivision is subject to restrictions recorded in the Office of the Tehama County Recorder, Book 563, Page 634; Amended December 10, 1975 in Book 678, Page 123; and further amended on May 26, 1978, in Book 750, Page 569, which include, among other provisions the following:

        You shall become a member of the Ridgecreek Property Owners’ Association and be subject to any assessment.

FOR INFORMATION AS TO YOUR OBLIGATIONS AND RIGHTS, YOU SHOULD READ THE RESTRICTIONS. THE SUBDIVIDER SHOULD MAKE THEM AVAILABLE TO YOU.

CONDITIONS OF SALE: If your purchase involves financing, a form of deed of trust and note will be used. These documents contain the following provisions:

        An Acceleration Clause. This means that if you default in your payment, the lender may declare the entire unpaid loan balance immediately due and payable.

PURCHASE MONEY HANDLING: The subdivider must impound all funds received from you in an escrow depository until legal title is delivered to you. (Refer to Section 11013.4(a) of the Business and Professions Code.)

FLOOD AND DRAINAGE: The Tehama County Flood Control and Water Conservation District advises:

        This property is southwest of Red Bluff between Balis-Bell Road and Red Bank Road and is rolling to steep with scrub oak cover.

        The U.S. Department of Housing and Community Development – Preliminary Flood Hazard Boundary Maps for Tehama County shows the creek areas along Balis-Bell Road (north fork of Red Bank Creek) and Red Bank Road (Red Bank Creek) to be inside “Special Flood Hazard Areas”.

WATER: There is no regular water service to this tract. Private water wells are the only source of water in this tract and you will be required to pay all costs to have a well installed. The subdivider advises that:

Estimates from well drillers indicated the cost for drilling to be $14.00 to $15.00 per linear foot. Depending on the location in which a well is drilled it would probably be necessary to drill between 150’ to 300’ to obtain potable water in sufficient quantities. This would include a 6” casing.

 

The cost for a pump and pressure system, installed, is estimated to be between $1,000 and $2,500, depending upon the size and type.

 

An existing well on the property has a 6” casing, a submersible pump at 65’ and a water level of 20’ to 30’.

The State Water Code requires a Notice of Intention to drill a well and a Report of Completion to be filed with the Department of Water Resources.

FIRE PROTECTION: The California Department of Forestry advises as follows:

        “The California Department of Forestry, under agreement with the County of Tehama, suppresses all fires burning uncontrolled outside any incorporated territory of Tehama County.

These parcels are located in the unincorporated territory of Tehama County.

In the event of a fire, the following fire suppression equipment would respond: Triple combination, structure type engines would respond year around from the Red Bluff and Proberta Schedule “A” Stations. In addition to the Schedule “A” Units responding, one Tehama Rural Fire Department Unit from the Schedule “C” Fire Department located in Antelope would be initially dispatched if required.

During the Fire Season (dry months) equipment from the California Department of Forestry Headquarters in Red Bluff, Red Bank, Baker and Paskenta Fire Control Stations would also respond.

These parcels are located in an area which is dry with flash fuels during the summer months as is most of the Tehama County wildlands.

GAS: Natural gas is not available.

ELECTRICITY: Pacific Gas and Electric Company advises:

“That electric distribution facilities exist a considerable distance from the various parcels of land and cannot be extended under the standard provisions of our extension rules.”

You should contact PG&E for extension costs prior to signing a purchase agreement.

TELEPHONE: Pacific Telephone and Telegraph Company advises that no provision has been made with the Developer to provide facilities to these parcels and since this area is outside of the base rate area, the individual applicant would be required to pay in advance a line extension charge to and upon the property to be served. Upon a valid application for telephone service, Pacific Telephone will provide the line extension charges to the applicant in accordance with their tariffs.

Pacific Telephone will then furnish, install, and maintain the service connecting wire or cable.

Normal service connection charges will also be applied.

Note: You should contact Pacific Telephone for specific charges.

SEWAGE DISPOSAL: Septic tanks will be used for sewage disposal. You must pay for your septic tank. A contractor estimates the cost to be between $1,200 to $1,800. Prior to commencing construction, you should contact the local health department for specifications, requirements and any local problems.

STREETS AND ROADS: The roads within this subdivision are private. Access to parcels will be by mutual and reciprocal easements. The private roads inside the project will be maintained by the homeowner association. The costs of repair and maintenance of these private roads are a part of your assessment. These roads are not constructed to the same standards as public roads which are maintained by the county. As a result, you may be faced with more rapid deterioration and repair costs may be a major assessment factor due to the necessary higher frequency of repairs.

An engineer estimates it will cost lot owners $15.40 per lineal foot to bring roads to county standards and that the annual cost for maintaining roads as existing at time of sale will be $.379 per lineal foot. The existing roads are approximately 10’ in width with some wider sections.

SHOPPING FACILITIES: Full services are available in Red Bluff.

PUBLIC TRANSPORTATION: Regularly scheduled public transportation is not available.

SCHOOLS: The Reeds Creek School District (K-8) provides the following information:

The school district provides bus transportation to approved bus stops only. The nearest stops for this property are at the junction of Hesse Road and Johnson Road and at the Montgomery or Red Bank Fire Station. These stops are approximately 7 and 15 miles from school.

The Red Bluff High School District provides the following information:

The farthest lot in the Tract is approximately 23 miles from Red Bluff, and high school students living in this area would attend Red Bluff Union High School. Transportation for these students would be provided at no cost to the students. The distance from the farthest lot to the bus stop is approximately 7 miles. The bus stop is at Montgomery Fire Station.

The Board may provide money in lieu of transportation when in its judgment it is not economical or practical to provide transportation.
