Meeting Minutes

1) Call to Order:  1:35pm

 

Board members present:  Kim Rowe, David Weston, Mandy Kleykamp, Mike Derrig

 

Landowners present:  LANDOWNER and LANDOWNER, LANDOWNER, and LANDOWNER

 

Guests:  FORMER LANDOWNER and FORMER LANDOWNER

 

2) Approval of Agenda (Add-Ins or Deletions):  No additions or deletions

 

Motion to approve the agenda:  Mandy Kleykamp, second David Weston

Ayes:  5

Nays:  0

 

3) Treasurer’s Report

 

Entry Drive gate and Barbie Dell gate repairs.  Both gates smashed by accident. Landowner replaced Entry Drive gate with new gate.  New gate was removed from its hinges by a non-landowner.  Gate would not hang properly thereafter.  Gate was repaired by welding the hinges at a cost of $200.  The gate at Barbie Dell has been straightened by a mystery person. A replacement gate has been ordered by the individual involved, it may be this weekend, but will be in very soon.  The present gate is functional.

 

Update on judgment for delinquent generator account. Judgement of $2,960 awarded September 4, 2001.  To date, landowner has paid $843 toward judgment.

 

4) Discuss Emergency Road Maintenance Issues:  LANDOWNER sent a letter to the board requesting road maintenance on Bright Star Lane.  LANDOWNER is no longer a landowner. Whether or not to maintain Bright Star Lane as requested by former owner.

 

A discussion took place and the members heard a proposal and estimate of charges to have Thomes Creek Rock deliver gravel for the Bright Star slick, the areas along Road Kill that are slippery and washed out, a small area on Northridge Road just west of the Northlake turnoff, and to put aggregate base at Entry Drive gate.  Large gravel on Bright Star and Road Kill, and the application of base rock on Northridge and at the gate.

 

Motion:  LANDOWNER moved to approve the purchase of gravel and application, David Weston seconded.

Ayes:  4

Nays:  0

 

5) Discuss and Approve Assessments or Fees for Road Obstructions:  Whether or not landowners should be assessed a fee for road obstructions which hinder or prevent access to other landowner properties (ie., abandoned vehicles, large boulders placed on roads, gates installed without approval of all affected landowners, etc.)

 

Motion:  There was no motion made.

 

6) Discuss and Approve Road Maintenance Signs:  Whether or not the association should post signs at the main gates to advise landowners and visitors of road maintenance, due diligence, and liability.

 

Motion:  Mandy Kleykamp made a motion to prepare signage and to add that owners obstructing any road will be responsible to other landowners who may be blocked out of their properties. Mike Derrig seconded.

Ayes:  4

Nays:  0

 

7) Discuss grazing lease for the 2006-2007 term:  Whether or not a clause be added to grazing lease to require the cattleman to remove dead cow carcasses if requested.

 

There was a brief discussion with concensus that carcass removal is difficult, hazardous, and unless it poses an immediate threat to health, the landowner could dispose of remains as they see fit.

 

Motion:  No action was taken.

 

8) Red Bank Oaks Pager:  Whether or not to continue with a Red Bank Oaks emergency pager indefinitely until such time as landowners wish to eliminate the pager.

 

Dave Weston said he had had no calls to the pager during the period he’s had it.

 

Motion:  LANDOWNER moved to abandon the pager, Mike Derrig seconded.

Ayes:  4

Nays:  0

 

9) Red Bank Oaks Website:  Whether or not to continue with the Red Bank Oaks website indefinitely until such time as landowners wish to eliminate the website.

 

Motion:  Mandy Kleykamp moved to maintain the website indefinitely.  David Weston seconded the motion.

Ayes:  4

Nays:  0

 

10) Discuss Amendment to Meeting Minutes from 22 October 2005 Meeting:  LANDOWNER requested the following amendments to the October 22, 2005 meeting minutes:

 

“It is a common myth that the appearance of structures, yards, etc. of parcels in the country affects the value of surrounding parcels. There is no evidence to that effect. That concept applies (though not with 100% validity) to city and suburban lots.”

 

“A few people told me that a person (not me) is polluting the creek with septic waste. I then compared that person’s (not my) amount of waste in the creek (if true) to that of cattle.”

 

Motion:  Mandy Kleykamp moved to approve the amendments.  David Weston seconded the motion.

Ayes:  4

Nays:  0

 

11) Identify items to be on the October 2006 agenda:  LANDOWNER requested the following items be added to this agenda.  Because notice for this meeting had already been posted and sent, and said notice informed landowners that a full vote of the landowners is not required for any of the items on the agenda and that proxies were not needed, these items will not be acted on at this meeting.  However, these items will be added to the October 2006 agenda.

 

- A vote to eliminate the electricity fund by striking it from the CC&Rs (an amendment strictly for that purpose).  Then, a vote to either a) divide the money amongst the owners, or – b) apply all the money to road maintenance.

 

Motion:  Moved to add to the October agenda by Kleykamp, seconded by David Weston

Ayes:  4

Nays:  0

 

- A vote to disband or eliminate the Association.

 

Motion:  No motion was made.

 

- A vote to initiate a third party independent audit of Association funds.

 

Motion:  A motion was made, but not seconded.  There was no vote.  At the private request of Mandy Kleykamp as an owner, the item will appear on the agenda.

 

12) Power Proposal:  Pat Young has a proposal to bring power down Red Bank Road to the Southeast corner of Red Bank Oaks.

 

Proposal:  FORMER LANDOWNER has a client, CLIENT, who proposes, at his expense, to bring power in to his property from Red Bank Road to the south.  The Board felt that in principal the Association’s easements are theirs to approve or disapprove any proposed uses.  FORMER LANDOWNER and CLIENT are asked to bring a detailed project proposal to the Association for review by the general membership.  Ms. Rowe says that power lines must be underground where they cross her properties.  Other Board Members expressed concern that above ground lines represent a fire hazard and that without extensive tree and road maintenance the risk of above ground lines is too great.  The Board agreed to meet before October if CLIENT wishes to present his detailed proposal sooner.

 

Motion:_David Weston moved to allow CLIENT to bring his proposal to the general membership at the October meeting so that its specific costs, construction details, etc. could be discussed. Mandy Kleykamp seconded the motion.  The motion passed with all members voting yes.
