Cattle Grazing Lease

THIS INDENTURE, made the 1st of October, 200__ between Red Bank Oaks Property Owners' Association, LESSOR, and lessee known as ___________________ who resides at __________________________________. LESSEE HEREBY agrees to lease to LESSEE 2,674 acres, more or less, located in Section 3, 9, 10, 15, 16, and 21, T26N, R6W, MDB&M, beginning on November 1, 200__ and terminating June 1, 200__ for grazing purposes only. IN CONSIDERATION OF THIS AGREEMENT, LESSEE agrees and promises to pay LESSOR the rental sum of $13,500.00 payable as follows: $6,750 upon signing this lease to be received no later than October 1, 200__ and $6,750.00 on June 1, 200__.

LESSEE AGREES to indemnify and hold harmless LESSOR from any and all loss or damage arising from his operation of the acreage or his appurtenance or equipment or livestock and LESSEE agrees to carry comprehensive public liability insurance covering LESSOR and LESSEE.

LESSEE AGREES to maintain fences in good useful condition and not to over-graze the range by putting more than approximately 200 cows and calves or the equivalent in yearlings, horses, or mules.  LESSEE WILL, to the greatest extent possible, maintain minimally aggressive bulls on the range to prevent damages to people and properties located on the range.  LESSOR RESERVES the right for its members to enter the leased premises at any time in their pursuits as long as their presence does not interfere with the operation of the LESSEE.

IT IS FURTHER AGREED that if rent is due and unpaid, LESSOR may terminate this agreement and the LESSEE will vacate the premises upon demand.  Should it become necessary for LESSOR to employ an attorney to enforce any of the conditions or covenants hereof, including the collection of rents or gaining possession of the premises, LESSEE agrees to pay all expenses incurred, including reasonable attorney fees.

LESSEE AGREES not to assign this agreement, in whole or in part, to a third party without the written consent of LESSOR.  THIS AGREEMENT shall apply to and bind the heirs, successors, executors, administrators, and assigns of the party hereto.  SIGNED AND EXECUTED IN DUPLICATE as of the date first mentioned above.
