Notice to 6 Landowners with Delinquent Generator Accounts

[Landowner],

 

Our records indicate you are still under contract for the purchase of a Kubota generator from the Red Bank Oaks Property Owners' Association.

 

Our records also indicate we received your last payment [Date].  You're payments to date, to include [$xxx.xx] deposit, total [$xxx.xx].  The balance now due on your generator is [$xxx.xx.  Please forward full payment to the Association no later than 2 March 2001.

 

Reference your Kubota Generator Agreement and Promissory Note, you entered into the Agreement [Date] to purchase a 6.5 kilowatt Kubota Diesel Generator, Identification number [xxxxxx].  You agreed to pay [$x,xxx] in 60 equal installments of [$xx.xx] commencing [Date].  Installments were due and payable on the first day of each month by check.  The 60-month time-frame allocated for payment of your Promissory Note ended [Date], 5 years after the commencement date.

 

In May, 2001, all landowners will be provided the details of delinquent Association accounts and asked what legal actions they want the Board to take to resolve the delinquencies.  All responses will be evaluated to ensure they are legally viable and enforceable.  Landowners who are eligible to vote will then be asked to vote on which action will be implemented.  If your account is still delinquent at that time, you will be subjected to the action the Association takes.

 

Further, because your account is currently delinquent, you are rendered ineligible to vote on any matters of the Association in accordance with Red Bank Oaks Property Owners' Association CC&Rs, Article III "Management," paragraph 2 which states:

 

"Owners shall be entitled to one vote for each acre of the Properties in which they hold an interest so long as such owner is not then delinquent in the payment of any dues or other assessment by the Association."

 

We remind you that, in accordance with your Promissory Note, the Association has the option to require all sums remaining unpaid under the Note become immediately due and payable, without notice, demand, or presentment, and regardless of any prior forbearance, on the occurrence of your failure to make any payment within thirty (30) days after the date due under the terms of the Note.  You shall pay any costs of collection, including attorney's fees, in accordance with your Promissory Note.

 

I regret this letter was necessary to address your account.  Please submit all correspondence regarding this issue in writing to the Association Address posted at the top of this letter.
