1)  Call to Order:  Time:  1:53 PM

Board Members Present:

Kimberly A. Rowe, President            Mike Derrig, Vice-President

David Weston, Treasure            Miguel Tarazon, Adjutant            Ed Mehrer, Secretary

Landowners Present:  Only 15 Landowners present for 22 votes (Not enough for a quorum)

2)  Approval of Agenda:

Motion of Agenda Approved with one Add-In:  Vote Yes, Unanimous

Motioned by:  Mandy Kleykamp            2nd:  Miguel Tarazon

One Add-In to Agenda:  Priority to repair roads to owners (See under Road Maintenance)

3)  Treasure’s Report:  Presented by David Weston (See attached report)

4)  Road Maintenance Update:  Presented by Mike Derrig

Mike brought in a detailed map of association roads.  He discussed many different areas of concern.  With limited funds, we were going to be limited to what can be done.  #1 concern seemed to be Turkey Egg Lane.

Funds expended on association roads for 2003:  $0 ($2000 carryover to 2004)

The proposed expenditures for the association roads between October 2004–October 2005:  $4000.00

Motion to spend the $4000.00:  Voted Yes, Unanimous

Add-In to Agenda:

LANDOWNER motioned we spend more funds to get the roads repaired this year.

The motion was whether or not to allow $6,000 to be drawn from the current power reserves to support road maintenance and repair this year (October 2004-October 2005).  This action requires a majority vote of all the landowners since the funding would be drawn from the power fund reserve and effectively override the CC&Rs [reference CC&R, Article III, Management, para 6] (See voting card in envelope)

5)  Red Bank Oaks Website

Red Bank Oaks has maintained a website [www.RedBankOaks.org] Board members and landowners can access information anytime.  Landowners who attended the meeting were asked if the website will be maintained for the 2004-2005 term.  Price $11.95 a month.

6)  New Combinations for Entry Gates: Gate combinations are changed each year.

7)  Nominations for 2004-2005 Board of Directors, Red Bank Oaks

The nominations names for this year are listed below. Candidates receiving the highest number of votes will be elected as members of the board. Each director shall be elected for a term of one year but shall continue to serve until his successor is selected. Only five of the nominee’s will be on the Board of Directors. (There were not at least 35 or more parcels present, which is not a quorum, so voting cards are in your envelope). Nominee’s are:

8)  Discuss Tehama County’s Proposed Rules for Williamson Act Lands

Kim Rowe talked in depth about the proposed rule for the Williamson Act.  There is a review of the Assembly Bill in your envelope.

9)  Discuss Tehama County’s New Vehicle Abatement Program

Tehama County has adopted a Vehicle Abatement Ordinance [Ordinance Number 1821].  The accumulation and storage of abandoned, wrecked, dismantled, or inoperative vehicles or parts thereof on private property creates a condition tending to reduce the value of private property, promotes blight and deterioration, invites plundering, creates fire hazards, constitutes an attractive nuisance creating a hazard to the health and safety of minors, creates a harborage for rodents and insects, and is seen to be injurious to the health, safety, and general welfare of the residents of Tehama County.  The ordinance gives the county the authority to remove abandoned vehicles and parts from a landowner’s property five days after an order is published which declares the vehicles to be a public nuisance.  The administrative costs and the costs of removal are then charged against the landowner or last registered owner of the vehicle.  If the costs are not paid within 30 days of the date of the order, the costs will be assessed against the landowner’s parcel as an abatement lien and transmitted to the Tehama County Tax Collector for collection.  Red Bank Oaks landowners with abandoned vehicles on their properties are advised to secure a copy of the new ordinance from the County Clerk’s office.
